Sucessful Cases

As a Defence Lawyer

  • In the case of DM, my client and two others were charged with making forged passports in their immigration consulting business. Although the other two accused were found guilty and sentenced to the penitentiary, my successful defence of DM in a four-week trial resulted in the dismissal of all 180 charges.
  • In the case of DB, I successfully defended my client (charged with 3 others) on charges of Possession of $1 million worth of cocaine for trafficking purposes. I succeeded by persuading the judge that the case took too long to get to trial, so the judge dismissed all charges.
  • In the case of VM, I successfully defended my client on a charge of murder for decapitating his mother, by persuading the Crown not to proceed to trial on the murder charge because of my client's mental state at the time. Instead, the client was committed to a mental institution and released a few years later after his mental illness had stabilized.
  • In a case that received extensive media coverage throughout Canada, I successfully defended my client PO on charges of permitting indecent lap-dancing at a well-known Toronto gentlemen's club. The judge agreed with me that such dancing did not violate community standards of decency, and he dismissed all the charges.
  • In the case of LF Video, I successfully defended my client on charges of distributing pornographic pictures (movies) on videotape. I convinced the judge that since the videotapes themselves contained only electronic signals but no actual pictures, they contained no obscene images since the pictures could only be seen by using a television monitor.
  • In the case of DD, I successfully defended my client on historical sexual assault charges against his three (adult) nieces when they were all children. Despite detailed and similar testimony given by all three nieces, my meticulous cross-examination of each complainant showing all the contradictions in their evidence led to a dismissal of all 18 charges.
  • In the case of PQ, my client faced charges of first-degree murder and dismemberment for allegedly purchasing various tools at a hardware store to kill the victim and cut up his body into many pieces later found stuffed into some garbage bags. After the preliminary hearing where I tried to show all the weaknesses in the Crown's case, the Crown agreed to abandon the first-degree murder charge (which could have resulted in my client serving twenty-five years in prison before release) and accept a guilty plea to second-degree murder with parole eligibility after only fourteen years.

As a Crown Attorney

  • In a case that was later turned into a book and a motion picture, I prosecuted BM (a gambling addict defended by the late Mr. Edward Greenspan), for stealing millions of dollars from the bank where he worked as a manager and losing it through gambling in the casinos in Atlantic City. After BM's conviction, his lawyer urged the judge to pass a lenient sentence which I opposed, and the judge sentenced him to six years in prison.
  • In the case of ABC Records, ABC was charged with manufacturing and selling pirated copies of recordings of a world-famous Spanish singer. I successfully prosecuted the company which was sentenced to a substantial fine.
  • In a case attracting international media attention and leading to an expanded legal definition of obscenity, I successfully prosecuted DR (defended by the late Mr. Edward Greenspan) on charges of distributing obscene videotapes.
  • In the case of WM, I successfully prosecuted the defendant on a charge of first degree murder, for shooting his landlord in the head with a handgun at close range. Although WM claimed the gun was fired accidentally, I convinced the jury that the killing was planned and deliberate. They convicted WM of first degree murder and he was sentenced to life imprisonment.
  • I have also successfully prosecuted many other murder cases, where death was caused by various methods, through toxic injection, fistfight, bludgeoning with a hammer, beating with a barbell, drowning, stabbing with a pitchfork, knife attack and decapitation.

Testimonials

As a Judge of the Ontario Court of Justice for 25 years, I have had the pleasure and the privilege of presiding over many criminal trials where Mr. DeJulio defended clients on all types of criminal charges. He is always well-prepared to defend his clients and treats judges and other lawyers with dignity and respect. He is an excellent cross-examiner and can think very quickly on his feet when unexpected things happen in court - as they often do. He puts the same care, preparation and effort into every case he handles - whether it's something very serious, such as a homicide or something minor, like shoplifting. Anyone who decides to retain Mr. DeJulio as a lawyer will have made an excellent choice.

Bruno Cavion, retired judge of the Ontario Court of Justice

Mr. DeJulio has been appearing before me in the Ontario Court of Justice for many years. It has always been a pleasure to have him in my court, because he is very experienced, hard-working, talented, honest, respectful and trustworthy. It is obvious that he has a good working relationship with the Crown, and he never fails to fairly, astutely and firmly assert and protect his clients' best interests and their legal rights. He is confident and effective when it comes to conducting a trial or working out a plea bargain. I always felt that Mr. DeJulio got his client the best result that was possible in the circumstances (and he often got a better result than I would have expected). Mr. DeJulio is an excellent lawyer and a credit to the criminal defence bar. I have never hesitated to recommend him to friends and others who require the services of a first-rate defence counsel.
